Terms of Service

AegorIQ provides automated and expert-reviewed website risk reports — including a free scorecard — as well as paid Essentials and Expert tiers. These reports are advisory only: they're a snapshot of what we found at the time of scanning, not a guarantee of security or compliance, and not legal, security, or other professional advice. Where our reports include suggestions (Expert tier), these are general suggestions only — we don't implement changes for you. By using our service, you confirm you own or are authorised to have us scan the website you submit, and you take on the responsibility of deciding whether to seek independent legal or other professional advice before acting on anything in a report.

1. Who We Are

AegorIQ ("AegorIQ", "we", "us", "our") is a trading name of WNMC Holdings Pty Ltd (ABN 55 698 239 502), operating in Australia. These Terms of Service ("Terms") govern your access to and use of the AegorIQ website, intake forms, and website risk review services (collectively, the "Services").

By submitting a request, making a payment, or otherwise using the Services, you ("you", "your", "Customer") agree to be bound by these Terms. If you do not agree, do not use the Services.

2. The Services We Provide

AegorIQ provides website risk review reports across three scored areas — security, compliance, and performance — plus an informational AI Readiness indicator (how discoverable and understandable your site is to AI assistants), which is provided for your awareness only and does not affect your score. Our service tiers are:

AegorIQ Free Scorecard — a complimentary, automated summary indicating the severity of potential issues found (categorised as Critical, Needs Attention, or Normal) without explanation of individual findings or recommendations. Provided at no charge, displayed once at the time of scanning, and not retained or re-accessible afterward.
AegorIQ Essentials — a fully automated report covering security, compliance, and performance indicators, generated using automated scanning tools and AI-based analysis, including plain-English explanation of each finding.
AegorIQ Expert — includes everything in Essentials, plus a deeper automated and AI-assisted analysis with review by a qualified cybersecurity professional, delivered within the stated timeframe.

Optional add-on services (including expert consultation calls and fix verification re-scans) may be purchased separately and are subject to these Terms.

Critical — Scope Limitation

AegorIQ Services are advisory reports only. They do not constitute a penetration test, security certification, legal advice, or compliance certification. Our reports identify potential issues based on automated scanning and analysis at a single point in time. They are not exhaustive and may not identify every vulnerability, risk, or compliance gap present on your website. This applies equally to the Free Scorecard, AegorIQ Essentials, and AegorIQ Expert.

Critical — Suggestions, Not Implementation

Where any AegorIQ report or communication includes guidance on addressing a finding (including under AegorIQ Expert), this guidance constitutes general suggestions only. AegorIQ does not implement, configure, fix, or otherwise modify your website or any system on your behalf under any Service tier. You, or a professional you separately engage, remain solely responsible for evaluating, deciding upon, and carrying out any change. See also Clause 8 (Your Responsibility) and Clause 6 (Not Legal Advice).

3. Authorisation To Scan — Your Responsibility

By submitting a website URL ("Target Website") to AegorIQ for review, you warrant and represent that:

You are the owner of the Target Website, or you are an authorised representative of the owner with explicit permission to commission a security and compliance review of it;
You have the legal right to authorise AegorIQ (and any third-party scanning tools we use) to access and analyse the Target Website's publicly accessible pages and infrastructure;
All information you provide to us — including but not limited to the website URL, business details, and intake form responses — is accurate and not misleading.

Important

Submitting a website you do not own or are not authorised to have scanned may constitute an offence under the Criminal Code Act 1995 (Cth) and other applicable laws. AegorIQ accepts no liability for submissions that breach this clause, and reserves the right to refuse, suspend, or cancel any order — with no refund — where we reasonably suspect this warranty has been breached.

4. No Warranty

To the maximum extent permitted by law, AegorIQ provides the Services on an "as is" and "as available" basis. We do not warrant that:

Our reports are complete, accurate, or free from error;
Our reports identify all security vulnerabilities, compliance gaps, or performance issues present on the Target Website;
Your website will be secure, compliant with any law (including the Privacy Act 1988 (Cth) or the Spam Act 2003 (Cth)), or free from cyber-attack, following receipt of our report or implementation of any recommendations contained within it;
The Services will be uninterrupted, timely, or error-free.

5. Point-In-Time Assessment

All findings in an AegorIQ report reflect the condition of the Target Website at the specific date and time the scan was conducted. Websites, software, plugins, and threat landscapes change continuously. A report is not, and should not be relied upon as, an ongoing or current assessment of the Target Website's security or compliance status beyond that point in time.

6. Not Legal, Security, or Professional Advice

Compliance-related findings in our reports (including those relating to the Australian Privacy Principles, the Privacy Act 1988 (Cth), and the Spam Act 2003 (Cth)) are general informational observations only. They do not constitute legal advice. We strongly recommend you seek independent legal advice from a qualified Australian legal practitioner regarding your specific compliance obligations.

Similarly, security, performance, and technical findings and any accompanying suggestions (including under AegorIQ Expert) are general informational observations only. They do not constitute professional cybersecurity, IT, or web development advice specific to your circumstances. We recommend you seek advice from a qualified professional before making changes to your website or systems based on an AegorIQ report.

Due diligence in evaluating and acting on any AegorIQ report, including whether to seek further legal, security, or other professional advice, rests with you.

7. Liability

To the maximum extent permitted by law:

AegorIQ's total aggregate liability to you, arising out of or in connection with the Services (whether in contract, tort, negligence, or otherwise), is limited to the total amount you actually paid to AegorIQ for the specific Service giving rise to the claim, net of any discount or coupon applied;
For the AegorIQ Free Scorecard, which is provided at no charge, AegorIQ's total aggregate liability arising out of or in connection with that Service is limited to AUD $0;
AegorIQ will not be liable for any indirect, special, incidental, or consequential loss or damage, including loss of profits, loss of data, loss of business, or reputational harm, arising from your use of, or reliance on, the Services;
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded, restricted, or modified.

8. Your Responsibility

You are solely responsible for deciding whether and how to act on any finding, explanation, or suggestion in an AegorIQ report or communication. Implementation of any suggestion — including by you, your staff, or any third-party contractor — is entirely your responsibility. AegorIQ is not responsible for the outcome of any changes made to the Target Website, whether or not based on our report. Where you have legal, compliance, security, or other professional obligations, you should seek advice from a qualified professional in the relevant field before relying on or acting upon any AegorIQ report; AegorIQ's reports are not a substitute for that advice.

9. Fees and Payment

All fees are quoted in Australian Dollars (AUD). GST is not charged — WNMC Holdings Pty Ltd is not currently registered for GST. No GST is added to the price and none is included in it. If we become registered for GST, prices and this clause will be updated to say so before any GST is charged.
Payment is required in full prior to commencement of any scan or report generation, except for the Free Scorecard, which requires no payment.
Reports are delivered within the timeframe specified for the relevant service tier at the time of purchase. Timeframes are estimates and not guaranteed delivery dates.
Promotional discounts (including any discount referenced in a follow-up communication after use of the Free Scorecard) are offered at AegorIQ's discretion, may be time-limited as stated in the relevant offer, and do not affect the scope or nature of the Service provided.

Refunds

30-day money-back guarantee. For AegorIQ Essentials and Expert, if you don't feel your report gave you real value — whether it found problems to fix or confirmed your site is solid — email us within 30 days of your purchase and we will refund you 100%, no questions asked. This voluntary guarantee is in addition to, and does not limit, exclude or replace, your rights under the Australian Consumer Law (for example, where a Service is not provided with due care and skill, or is not fit for purpose). The Free Scorecard is provided at no charge, so no refund applies. Full details, including how to request a refund, are in our Refund Policy.

10. Intellectual Property

AegorIQ retains all intellectual property rights in its scanning methodology, scoring frameworks, report templates, and any proprietary tools or processes used to generate your report. Upon full payment, you receive a non-exclusive, non-transferable licence to use your report for your own internal business purposes. You may not resell, republish, sublicense, or claim authorship of an AegorIQ report.

11. Data Handling

Information you submit (including the Target Website URL and intake form responses) is used solely to provide the Services. Our handling of your personal information is described in our Privacy Policy, which forms part of these Terms.

12. Misuse of the Service

AegorIQ reserves the right to refuse service, suspend an order, or decline to deliver a report — without refund — where we reasonably believe:

The submission breaches Clause 3 (Authorisation To Scan);
The Target Website is malicious, illegal, or designed to harm others;
The submission is fraudulent, abusive, or intended to misuse or overload our systems (for example, submitting an excessively large website without prior arrangement);
Information provided is false or misleading.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. The version in effect at the time you place an order will govern that order. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Victoria, Australia, and any courts entitled to hear appeals from those courts, in respect of any matter arising out of or relating to these Terms or the Services.
