The short version. The badge records that we independently reviewed your website on a particular date, and what that review found. It is not a certification and not a guarantee. Display it using the code we give you, don't alter it, and don't describe your business as "certified" or "verified" on the strength of it. It updates itself, and it lapses after 12 months unless you have a current review.
These Terms of Use ("Terms") govern your display and use of an AegorIQ Trust Badge ("Badge") and the associated verification page ("Verification Page"). The Badge and Verification Page are provided by AegorIQ, a trading name of WNMC Holdings Pty Ltd (ABN 55 698 239 502) ("AegorIQ", "we", "us"). By publishing or displaying the Badge on any website, you ("you", "the Customer") agree to these Terms. If you do not agree, do not display the Badge.
1.1 The Badge indicates that the website identified in your order (the "Assessed Site") was the subject of an independent, point-in-time review by AegorIQ as at the date shown on the Badge, and that, at that date, it met the criteria for the level displayed. Those criteria are described on the Verification Page.
1.2 The Badge is not: a certification; a warranty or guarantee that the Assessed Site is secure, private, or legally compliant; a penetration test; confirmation of ongoing compliance; or legal advice. Website security, privacy and compliance can change at any time after the review date. Where a matter is a legal question, AegorIQ flags it for professional review rather than making a determination.
1.3 The Badge reflects the status of the Assessed Site only as at the date shown, and only in respect of the matters AegorIQ reviewed. Some checks cannot be completed for reasons outside our control; those are listed by name on the Verification Page.
1.4 The three levels are Committed, Reviewed and Reviewed in depth. What each requires is set out on the Verification Page and at aegoriq.com.au/trust-badge.
2.1 Subject to these Terms, AegorIQ grants you a non-exclusive, non-transferable, revocable licence to display the Badge solely on the Assessed Site, and solely for the period the Badge is valid (clause 4).
2.2 You may not display the Badge on any website other than the Assessed Site, sub-licence it, or allow any third party to use it.
2.3 The licence begins when you choose to display the Badge. Issuing a Badge to your account is not, by itself, publication: until you opt in, the Badge displays nothing and no Verification Page for your business exists.
You agree to:
4.1 The Badge is dated and time-limited. Every Badge, at every level, is valid for 12 months from the date of the paid assessment it was issued against. A free re-scan within your re-scan period may change the level displayed, but does not extend this period.
4.2 The level of any renewed Badge is determined by the new assessment, not the previous one. A Badge is re-earned, not carried over: if a renewed assessment does not meet the criteria for the level you previously held, the Badge will display the level the new assessment does meet. Some levels require a particular assessment type — a Reviewed in depth Badge requires an assessment that includes the in-depth review, and an assessment that does not include it cannot produce that level.
4.3 Because the Badge renders live from AegorIQ's servers, it will automatically update or lapse to reflect your current status. If your status changes (for example, a re-assessment identifies a critical issue), the Badge may change level. On expiry the Badge ceases to display: it is served as a blank image so that it simply no longer appears on your website, rather than displaying anything negative.
4.4 You are responsible for maintaining a current assessment if you wish to keep displaying a valid Badge. AegorIQ will ordinarily send a reminder before expiry, but is not obliged to do so.
You represent, warrant and agree that:
6.1 AegorIQ may suspend, revoke, or cease serving the Badge at any time, including where: the assessment criteria are no longer met; these Terms are breached; information you provided was inaccurate; or AegorIQ reasonably considers continued display could be misleading.
6.2 On revocation or expiry, you must remove the Badge and any reference to it from the Assessed Site within 5 business days.
6.3 You may stop displaying the Badge at any time, for any reason, without notice to us. Turning it off takes one click on your badge settings page.
The level of a Badge is determined by AegorIQ's assessment against objective criteria described on the Verification Page. Payment is for the assessment, not for any particular result or level — a higher level cannot be purchased and is earned only if the criteria are met. Purchasing a more detailed assessment may make a higher level reachable, but does not confer it.
The Badge, the AegorIQ name and logo, the Verification Page, and all associated materials are owned by AegorIQ and its licensors. Except for the limited licence in clause 2, no rights are granted to you.
9.1 To the maximum extent permitted by law, and subject to clause 9.2, the Badge and Verification Page are provided "as is", and AegorIQ makes no warranties about the security, privacy, compliance, or fitness of the Assessed Site.
9.2 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where AegorIQ's liability can be limited, it is limited (at AegorIQ's option) to re-supplying the relevant service or paying the cost of re-supply.
You indemnify AegorIQ against any claim, loss, or liability arising from: your display or use of the Badge in breach of these Terms; any inaccurate information you provided; or any representation you make about your site or business that is misleading or deceptive.
To the maximum extent permitted by law and subject to clause 9.2, AegorIQ is not liable for any indirect or consequential loss, and AegorIQ's total liability arising from the Badge is limited to the amount you paid for the assessment the Badge was issued against.
If you opt in to be featured on the AegorIQ Trust Wall or our channels, you consent to AegorIQ publishing your business name, logo, link and any quote you supply, and you confirm you are authorised to grant that consent. You may withdraw consent by contacting us, and we will remove the feature within a reasonable time.
13.1 The Verification Page is a public page. When you opt in to display the Badge, it shows your business name, the reviewed domain, the level, the review date, and the checks that could not be completed.
13.2 Until you opt in, no such page exists and the Badge endpoint returns nothing. How we handle the underlying assessment data is set out in our Privacy Policy.
We may update these Terms from time to time. The version published at aegoriq.com.au/badge-terms applies to your continued display of the Badge. If a change materially affects your rights, we will make reasonable efforts to tell you.
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts.
